Terms of Use

These Terms of Use (“Terms”) govern your access to and use of CAPA Engine, a service operated by Freelong Health, LLC (“Freelong Health,” “we,” “us,” or “our”). By using CAPA Engine, you agree to these Terms.

1. Use of the Service

CAPA Engine is provided as a professional drafting and analysis tool to assist with nonconformance review, probable cause analysis, corrective action drafting, and related quality documentation workflows. You may use the service only in compliance with applicable law and these Terms.

2. No Legal, Regulatory, or Quality Guarantee

CAPA Engine provides AI-assisted outputs for informational and workflow support purposes only. It does not constitute legal advice, regulatory advice, quality system certification, auditor approval, or a guarantee that any output is complete, accurate, compliant, or fit for a particular purpose. You are solely responsible for review, verification, approval, and use of all generated content.

3. Account Responsibility

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information and to notify us if you suspect unauthorized access.

4. Acceptable Use

You agree not to:

• Use the service for unlawful, fraudulent, or deceptive purposes.
• Attempt to reverse engineer, disrupt, or interfere with the platform.
• Upload malicious code or attempt unauthorized access.
• Use the platform to infringe intellectual property or privacy rights.
• Misrepresent AI-generated output as reviewed, approved, or certified by Freelong Health.

5. User Content

You retain responsibility for the information you submit to CAPA Engine. You represent that you have the rights and authority necessary to submit that content and to use it with the service. You grant us a limited, non-exclusive right to process that content solely to operate, maintain, and improve the service.

6. Fees and Payments

Certain features may require payment or subscription. If paid plans are offered, pricing, billing intervals, and usage limits will be presented at checkout or on the pricing page. Payments may be processed through a third-party payment provider. Except where required by law, fees are non-refundable once paid.

7. Intellectual Property

CAPA Engine, including its software, branding, design, site content, and related materials, is owned by or licensed to Freelong Health, LLC and is protected by applicable intellectual property laws. These Terms do not transfer any ownership rights to you.

8. Service Availability

We may modify, suspend, or discontinue all or part of the service at any time, with or without notice. We do not guarantee uninterrupted or error-free operation.

9. Disclaimer of Warranties

The service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Freelong Health disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and reliability.

10. Limitation of Liability

To the fullest extent permitted by law, Freelong Health, LLC will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of data, revenue, profits, or business opportunities arising out of or related to your use of CAPA Engine. Our total liability for any claim relating to the service will not exceed the amount you paid us for the service during the 12 months preceding the event giving rise to the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Freelong Health, LLC from and against claims, liabilities, damages, losses, and expenses arising out of your use of the service, your content, or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the service if we reasonably believe you have violated these Terms or if necessary to protect the service, other users, or our business.

13. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the service after updated Terms are posted constitutes acceptance of the revised Terms.
